A Gwinnett teenager was tragically killed by a hit and run driver while riding his bicycle last night on Buford Highway. Jacob Paoleta, of Lawrenceville died at the scene, while his friend and fellow bicycle rider, Walter Lester, was taken to Gwinnett Medical Center for his injuries. According to the Gwinnett Police Department, officers later found the responsible hit and run vehicle abandoned in a nearby subdivision. As of the time of this post, the officers were still trying to locate the responsible driver.

Once the responsible party is found, a wrongful death action may be appropriate for his wanton and seemingly willful actions. The proceeds from such a suit will never come close to fully compensating Mr. Palleta's family but it could help them in the days ahead and through the healing process.

Aside from the criminal aspects this driver will soon be facing, a wrongful death suit could help deter such deplorable actions in the future.

Jacob was my 17 year old son that was murdered by this coward, Edgar Pena-Fernandez who today 2 months later is still free. His wife lied to police said she was a neighbor and had not seen the murderer for several weeks - she is now long gone. Fernandez was driving with a suspended licesne so even though he is in the National crime database he will elude justice. My son's murderer may not face justice on earth but God will judge him for his actions and cowardness. How can this man and woman be together, look in the mirror and live knowing he killed an innocent boy and left the scene. DO they not think of Jacob's family and his twin brother? I could forgive Pena-Fernandez if he had come back even 2 weeks later and accepted resposnibilty but 2 months later he is nothing more than a coward and murderer.

Cynthia:

I can not even begin to comprehend the loss that you are currently enduring from the loss of Jacob. I can only send my deepest sympathies and prayers to you and your family. Every time of I hear of situations like this it infuriates me to no end. This tragic incident is the prime example why I have spent my years as an attorney fighting crime and protecting those, like yourself, who have been seriously wronged or injured by the neglect and carelessness of others. Nothing will ever take the pain away I am sure but I truly hope they prosecute this guy for his reprehensible actions one day. Don't give up hope on the capture and prosecution of him. People like this have a way of finding trouble and eventually he will be found and forced to take accountability for his deplorable actions.

Aside for the official police investigation that I can only assume is still ongoing, there are other avenues and approaches that firms like mine take in our efforts to catch and help locate such wanton criminals. If I may ever be of assistance to you and or your family please contact me and I will be happy to help ensure this guy pays for what he has done at no cost to you.

In the interim, I wish both you and your family the best and pray this guy will be caught in the very near future. Please keep me apprised of any developments as I would love to see him get exactly what he deserves one day.
