A new Jersey jury found Vioxx had concealed the dangers of its painkiller Vioxx and awarded one of the two plaintiff's $4.5 million dollars in compensatory damages. A second trial for the sole purpose of determining if punitive damages should be awarded is scheduled to start today. Generally, punitive damages, if awarded, can range anywhere from two to ten times the award given in compensatory damages if willful and wanton conduct is shown.

This verdict should go a long way in the court of public opinion. The tort reformers will have a difficult time spinning this as a bogus verdict from a runaway jury. Since the jurors only found in favor of one of the two plaintiffs, it demonstrates their objectivity and should inspire confidence in the civil justice system.
